Having a trip or slip in the street, at work or in a public place can cause quite serious injuries to the young and elderly and in many cases, it could have been prevented.
As with any other claim, the owner of the land or property where you fell has a duty to keep it in a reasonable condition to minimise the chances of an accident. Councils have a duty to keep the pavements and roads in a good condition, as do supermarkets and shops to keep their floors clean and dry.
Just because a paving slab is sticking up or there is a pothole in the Tarmac, it does not automatically mean that the local council or landowner is negligent. There are a number of rules and regulations involved and it is vitally important that you get an expert involved sooner rather than later.
If there is any advice that we can give you here, it is, do not talk or write to the Council or Landowner until you have taken advice. One of the reasons is that it is not unusual for someone to carry out an emergency repair and then try to deny that the defect was ever there.
